Orange County DUI Arrest - DUI Court
In Orange County, DUI Court is a voluntary program available to 2nd DUI and 3rd DUI offenders who meet program requirements and may drastically reduce a Orange County DUI offender's jail sentence.
DUI Court is an extensive court-supervised, comprehensive alcohol and drug treatment program for Orange County DUI Offenders.
What Does DUI Court Consist of?
The program is extensive and includes random alcohol and/or drug screening, regular attendance at alcohol and/or drug related self-help meetings, regular court appearances before a designated DUI Court judge at the Newport Beach, Harbor Justice Center facility.
You also have a probation officer who will visit you and search your house for forbidden items such as drugs and/or alcohol.
The programs length is determined on the circumstances of your DUI arrest but is no less than 12 months.
Eligibility for the Newport Beach DUI Court Program
Eligibility is restricted to 2nd DUI or 3rd DUI offenders who have no record of violence, drug sales, and/or distribution. Thereby, if you have ever been convicted of Domestic Violence, Battery, Drug Trafficking or the like, you will be automatically ineligible for DUI Court.
In addition, eligibility is restricted to those who reside within Orange County. Orange County residency is mandatory and no exceptions are made.
DUI Court Rules
1. Do not use or possess any drugs and/or alcohol.
2. Attend ALL ordered treatment sessions.
3. Report to your Probation Officer as directed.
4. Submit to random alcohol and/or drug screening.
5. Be on time for ALL appointments including court appearances.
6. Do not make threats toward other participants or staff or behave in a violent manner.
7. Dress appropriately for treatment therapy sessions and the court.
8. Remain seated and quiet at all times while in court.
9. You are prohibited from acting as a police informant.
10. Comply with all requirements of each step of the treatment program.

After acceptance into the program, a Orange County DUI offender is given a 2 week trial period to determine if the DUI Court program is a proper fit for his or her lifestyle.
Following the introductory period, if you fail or get kicked out of DUI Court, you will be required to go to jail. Not House Arrest, Not SCRAM, Not Pay-to-Stay Work Furlough program: Jail. County Jail.
